6:00 PM Regular Monthly Meeting

REGULAR MONTHLY MEETING MINUTES

At 6:00 PM, the Village Board of Trustee’s met in Regular Session, those in attendance were, President Dale Murbarger, Trustee Troy Fender, Trustee Steve Stortzum, Trustee Nancy Byers, Trustee Gina Rinehart and Trustee Angie Frye. Also in attendance were Attorney Barry Bright, Clerk Angela Stanfield, Treasurer Stephanie Bailey, Superintendent Troy Elwood, Engineer Mike Bridges, Beth Fancher of Clay County Republican, Pat Garrett of WNOI, Citizen John Rourk, Jean Bailey of Genealogy Society, David McDevitt of McDevitt Osteen Chojnicki & Deters, LLC. Trustee Danny Miller absent. Sheriff Andy Myers of Sheriff Department delivered activity report, he was not able to attend village meeting due to the county meeting.

President Murbarger called the meeting to order at 6:00 PM.

Roll Call taken and the following Village authorities announced present at the beginning of the April 14, 2016 regular meeting: President Dale Murbarger, Trustee Troy Fender, Trustee Steve Stortzum, Trustee Nancy Byers, Trustee Gina Rinehart and Trustee Angie Frye.

Pledge of Allegiance followed.

A motion made by Trustee Byers and seconded by Trustee Rinehart to approve the agenda for April 14, 2016 regular meeting. Trustee Miller absent.

5 Ayes – 0 Nays – 1 Absent – Motion Carried

A motion made by Trustee Frye and seconded by Trustee Fender to approve the regular monthly meeting minutes for March 14, 2016 and special meeting minutes for April 04, 2016 with no changes. Trustee Miller absent.

Jean Bailey presented breakdown of repairs costs for the Clay County Genealogy Society Library building, total cost of $6,106.72. Village board reviewed breakdown and informed Jean Bailey the board would consider and discuss reimbursement amount, due to the village possibly being partially liable for damages, per structural engineer’s report.

President Murbarger announced village board would enter into executive session for the purpose to discuss proposal presented by David McDevitt of McDevitt Osteen Chojnicki & Deters, LLC, for consideration of employment for outside legal counsel for litigation against Norma Jean Bailey to resolve her buildings’ encroachment on village owned cemetery property.

President Murbarger stated Trustee Miller was unable to attend meeting due to being out of town and asked the board to consider approving Trustee Miller to attend closed session with cell phone, village board determined to not allow Trustee Miller attend closed session due to not having access to secure landline.

A motion to enter into Executive Session was made by Trustee Frye and seconded by Trustee Rinehart at 6:12 PM for the purpose to consider proposal presented by David McDevitt of McDevitt Osteen Chojnicki & Deters, LLC, for outside legal counsel for conducting litigation against Norma Jean Bailey to resolve her buildings’ encroachment on village owned cemetery. Trustee Miller absent.

The Village Board of Trustees returned to open session at 7:09 PM on a motion by Trustee Stortzum and seconded by Trustee Fender. Trustee Miller absent.

Sheriff Andy Myers of Clay County Sheriff’s Office delivered the Activity Report for

March 2016 prior to the meeting, village board reviewed the Activity Report.

A motion made by Trustee Fender and seconded by Trustee Frye to approve advertisement with Clay County Republican for Graduation Ad. Trustee Byers voting no. Trustee Miller absent.

A motion made by Trustee Rinehart and seconded by Trustee Frye to approve $100 donation to North Clay High School Blessing in a Backpack. Trustee Miller absent.

Engineer Mike Bridges presented certificate of substantial completion for waterline project and Clay Water interconnect project. A motion made by Trustee Rinehart and seconded by Trustee Frye to authorize President Murbarger to sign certificate of substantial completion as recommended by Engineer Mike Bridges.

Engineer Mike Bridges stated bid opening for the Pocket Park Wall Protection project will be April 28, 2016 at 10:00 AM.

Superintendent Elwood discussed mobile home permit for 515 Hayes Street. A motion made by Trustee Fender and seconded by Trustee Strotzum to approve permit, as long as superintendent inspects setback restrictions and informs the property owner that they are responsible for any additional cost. Trustee Miller absent.

Superintendent Elwood reported on water hardness, the test results for village water lowered in hardness to six grains of hardness. Superintendent Elwood will continue to follow up with additional certified testing.

Superintendent Troy Elwood reported on the water tower cleaning and inspection, and stated the report was good.

Superintendent Troy Elwood updated on the gas line to the new water pump station. The engineer of gas system recommends boring the new gas line.

Superintendent Troy Elwood stated the warehouse storage building moving project is halfway complete, materials are being inventoried during the moving process.

Village board discussed boil order procedures, and Superintendent Elwood stated that the village’s procedures for notifying the public of boil order is more than adequate under rules and regulations.

Superintendent Elwood updated on K-1 Roof project, stating construction is delayed due to weather.

Trustee Stortzum inquired about K-1 Building possibly of sale thereof.

Superintendent Elwood is accepting application for summer help through May 13, 2016.

A motion made by Trustee Byers and seconded by Trustee Rinehart to approve Central IL Public Transit Program Coordination Agreement. Trustee Miller absent.

President Murbarger presented information regarding golf carts to be discussed at strategic planning meeting.

A motion made by Trustee Fender and seconded by Trustee Byers to approve to employ outside legal counsel, David McDevitt of McDevitt Osteen Chojnicki & Deters, LLC, for litigation against Norma Jean Bailey to resolve her buildings’ encroachment on village owned cemetery property, also $7500 retainer was approved to be paid to Attorney McDevitt. Trustee Miller absent.

President Murbarger inquired about the Clay County Genealogy Society Library building repair cost of $6,106.72 presented by Jean Bailey. A motion made by Trustee Stortzum and seconded by Trustee Rinehart to approve $3,106.72 payment to the Genealogy Society for damages caused by the village’s shared wall, per recommended by the structural engineer’s report, provide that the village receives a full release of liability for such damages from the society. Trustee Miller absent.
