April 20, 2017

6:00 PM Regular Monthly Meeting

REGULAR MONTHLY MEETING MINUTES

At 6:00 PM, the Village Board of Trustee’s met in Regular Session, those in attendance were, President Dale Murbarger, Trustee Troy Fender, Trustee Angie Frye, Trustee Nancy Byers and Trustee Danny Miller. Also in attendance were Attorney Barry Bright, Clerk Angela Stanfield, Treasurer Stephanie Bailey, Engineer Mike Bridges, Superintendent Troy Elwood, Beth Fancher of Clay County Republican, John Rourk, Rusty Harper, Kim Adair, Craig Clifton and Terry Clifton. Trustee Gina Rinehart arrived at 6:03. Trustee Steve Stortzum absent. Sheriff Andy Myers absent.

President Murbarger called the meeting to order at 6:00 PM.

Roll Call taken and the following Village authorities announced present at the beginning of the April 20, 2017 regular meeting: President Dale Murbarger, Trustee Troy Fender, Trustee Angie Frye, Trustee Danny Miller, and Trustee Nancy Byers. Trustee Gina Rinehart and Trustee Steve Stortzum absent.

 Pledge of Allegiance followed.

 A motion made by Trustee Frye and seconded by Trustee Byers to approve the agenda for April 20, 2017 regular meeting. Trustee Rinehart and Trustee Strotzum absent.

 A motion made by Trustee Frye and seconded by Trustee Miller to approve the regular monthly meeting minutes for March 09, 2017, and special meeting minutes for April 05, 2017 with no changes. Trustee Rinehart and Trustee Stortzum absent.

 President Murbarger stated the regular monthly meeting April 13, 2017 was rescheduled for April 20, 2017 due to not having a quorum.

 Sheriff Andy Myers of Clay County Sheriff’s Office delivered the Activity Report for March 2017 prior to meeting, and was not in attendance.

 Trustee Rinehart arrived at 6:03

 No motion made to consider donation to Clay County Hospice.

 No motion made to consider donation to Not-For-Profit Group “Girls 101”. The Group utilizes the village’s community center for monthly meetings at no charge.

 A motion made by Trustee Rinehart and seconded by Trustee Frye to approve Graduation Ad with Clay County Republican. Trustee Byers voting no. Trustee Stortzum absent.

 A motion made by Trustee Byers and seconded by Trustee Miller to set Village Town Wide Rummage Sales for June 03, 2017. Trustee Stortzum absent.

 Superintendent Troy Elwood reported Ameren CIPS did not submit the information to present to the board and will discuss at next month’s meeting.

 President Murbarger appointed Trustee Gina Rinehart and Trustee Angie Frye as committee members for the Housing Rehabilitation Grant. President Murbarger recommends new Mayor, Kim Adair appoint two committee members for the Housing Rehabilitation Grant at next month’s meeting. A motion made by Trustee Fender and seconded by Trustee Byers to appoint Trustee Gina Rinehart and Trustee Angie Frye to Housing Rehabilitation Grant Committee. Trustee Stortzum absent.

 Attorney Barry Bright presented Ordinance approving a two year agreement starting April 01, 2017 for Animal Control and Shelter Services with Clay County Animal Rescue and Shelter, an Illinois not-for-profit corporation. Agreement sum of $225 per month for twelve months and thereafter the sum of $250 per month for the next twelve months. A motion made Trustee Frye and seconded by Trustee Fender to approve two year agreement starting April 01, 2017 for Animal Control and Shelter Services with Clay County Animal Rescue and Shelter. Trustee Stortzum absent.

 During open time Terry Clifton of 327 Woods Lane addressed the board regarding a sewer back up issue on March 03, 2014. Clifton submitted letters stating cost from damages incurred due to sewer back up, which Terry Clifton implied the village was responsible for, due to the village main becoming obstructed by possible tree roots, causing the sewer to back up into Terry Clifton’s basement. Village Risk Management Insurance agent Julie Hearing was notified of the issue on March 04, 2014 and stated Terry Clifton was to inform his homeowners insurance of the sewer back up. The Village Risk Management Insurance agent Julie Hearing informed the village that there was no negligence to the village and therefore the village was not liable for the damages, however asked for Terry Clifton to submit detail of cost for damages due to the sewer back up. Terry Clifton did not submit cost for damages until March 06, 2017. Village board reviewed cost for damages submitted from Terry Clifton and agreed to submit request for damages due to sewer back up at 327 Woods Lane on March 03, 2014 to the Village Risk Management Insurance for review.

 During open time village board discussed sending informational news letters to residents, nuisance properties, water tower maintenance and strategic planning meeting.

 A motion to enter into Executive Session was made by Trustee Byers and seconded by Trustee Fender at 6:46 PM for the purpose of reviewing last month’s executive session meeting minutes, Personnel and Lease, Sale and/or Purchase of Real Estate or Possible Litigation. Trustee Stortzum absent.

 The Village Board of Trustees returned to open session at 7:02 PM on a motion by Trustee Fender and seconded by Trustee Frye. Trustee Stortzum absent.

 A motion to approve Executive Session Minutes for March 09, 2017 Regular Meeting made by Trustee Fender and seconded by Trustee Miller. Trustee Stortzum absent.

A motion made by Trustee Fender and seconded by Trustee Miller to approve monthly bills. Trustee Stortzum absent.

 Village board authorized Attorney Barry Bright to prepare ordinance to prohibit the sale of alcohol at retail by any liquor license holder from certain designated parcels located around the Village Square for approval at next months meeting.

  motion made by Trustee Fender and seconded by Trustee Rinehart to maintain all executive session minutes to remain closed and authorize village clerk to specify dates for executive session minutes that are up for review. Village clerk verified dates for review, May 09, 2013 to March 09, 2017 closed session minutes will remain closed.

Trustee Stortzum absent.

 During open time village board discussed MDG Properties, LLC loan closing date and also discussed the TIF fund.

 Also in open time President Murbarger stated he authorized Brittany Pagle to maintain landscaping for the Community Courtyard for one month.

 A motion to adjourn made by Trustee Fender and seconded by Trustee Byers at 7:24 PM. Trustee Stortzum absent.
