PUBLIC HEARING MINUTES

At 5:45 PM, prior to Regular Session Meeting, the Village Board held a public hearing for the proposed Tax Levy increase. Those in attendance were, President Dale Murbarger, Trustee Troy Fender, Trustee Danny Miller, Trustee Steve Stortzum, and Trustee Angie Frye. Also in attendance were Attorney Barry Bright, Clerk Angela Stanfield, Treasurer Stephanie Bailey, Mary Maxwell of Clay County Republican and Pat Garrett of WNOI. Public speakers present were Steve Wilson, Bob Stortzum, Dave and Sherry Harrington, Terry Clifton, and Kenny Ross. Trustee Rinehart arrived at 5:45. Trustee Byers absent.

President Murbarger called the Public Hearing to order at 5:45 PM.

Roll Call taken and the following Village authorities announced present at the beginning of the Public Hearing on December 10, 2015: President Dale Murbarger, Trustee Danny Miller, Trustee Troy Fender, Trustee Steve Stortzum, and Trustee Angie Frye. Trustee Nancy Byers and Trustee Gina Rinehart absent.

Trustee Rinehart arrived at 5:46 PM

President Murbarger stated that due to the proposed tax levy exceeding the five percent increase a Public Hearing was in order.

President Murbarger and Attorney Barry Bright explained the purpose of the increase of twenty five percent increase is primarily to replenish the IMRF Fund. The total property taxes levied 2014 with a five percent increase were $116,269. The Tax Levy would increase $29,000 per year for the next two years for estimated total property taxes to be levied for 2015 will be $145,336.

President Murbarger invited public speaker comments.

Steve Wilson, village business owner stated his concerns of not being able to afford to pay the increase.

Bob Stortzum made several comments on village spending; the village block party, Christmas lights, purchase of Wabash Telephone and roof maintenance on the old K-1 building and then asked the board to consider spending cuts instead of raising the property taxes.  

David and Sherry Harrington stated they agreed with Bob Stortzums comments.

Terry Clifton asked for an explanation of what the public hearing does.

Village board listened to all comments, then Trustee Steve Stortzum stated he was against the increase. Trustee Gina Rinehart questioned why Trustee Steve Stortzum had not stated he was against increase at prior meeting during discussion. Trustee Fender stated he didn’t want to pay higher taxes either, and he was in favor of looking for spending cuts. Trustee Miller stated he did not want to pay higher taxes either, but the village needed to raise the tax levy at proposed. President Murbarger stated with the state possibly putting a two year freeze property taxes, the village needs to plan appropriately.

A motion was made by Trustee Frye and seconded by Trustee Miller to adjourn the public hearing for the proposed Tax Levy increase. Trustee Byers absent.

REGULAR MONTHLY MEETING MINUTES

At 6:00 PM, the Village Board of Trustee’s met in Regular Session, those in attendance were, President Dale Murbarger, Trustee Troy Fender, Trustee Danny Miller, Trustee Steve Stortzum, Trustee Gina Rinehart and Trustee Angie Frye. Also in attendance were Attorney Barry Bright, Clerk Angela Stanfield, Treasurer Stephanie Bailey, Sheriff Andy Myers, Mary Maxwell of Clay County Republican and Pat Garrett of WNOI. Steve Wilson, Bob Stortzum, Dave and Sherry Harrington, Terry Clifton, and Kenny Ross attended the public hearing and stayed for the regular monthly meeting. Trustee Nancy Byers and Engineer Mike Bridges were absent. Superintendent Troy Elwood arrived at 6:15 due to a gas line issue with CIPS in alley on west side of square.

President Murbarger called the meeting to order at 6:00 PM.

A motion made by Trustee Rinehart and seconded by Trustee Frye to approve the agenda for December 10, 2015 regular meeting. Trustee Byers absent.

A motion made by Trustee Fender and seconded by Trustee Miller to approve the regular monthly meeting minutes for November 12, 2015 regular meeting and November 18, 2015 reconvened meeting with no changes. Trustee Byers absent.

Sheriff Andy Myers of Clay County Sheriff’s Office presented the Activity Report for November. Sheriff Andy Myers stated the high number of accidents were deer related.

Treasurer Stephanie Bailey presented the Risk Management renewal, and stated premium will go up six percent, with main premium $24,585 and workers comp $14,876 effective as of December 1, 2015. A motion to approve renewal made by Trustee Rinehart and seconded by Trustee Miller. Trustee Byers absent.

Superintended Troy Elwood arrived at 6:15

Superintendent Troy Elwood reported on the Community Courtyard maintenance.  Elwood presented the Structural Engineer report from Rhutasel and Associates, Inc. of Centralia. The report recommends the village install a new separation wall or curb to avoid continued deterioration to the shared wall. Additional recommendations for repair include cleaning and repainting, installing new trim at the ends of the wall, installing new top cap flashing, replacing the surface material and covering existing surface. President Murbarger recommend Structural Engineer, Bill Lueking attend next months meeting.

President Murbarger gave and update on the Enterprise Zone application. Murbarger stated application will be submitted soon. Attorney Barry Bright reported all necessary ordinances and agreements were all passed. Letters of support were discussed. President Murbarger expressed appreciation to the County Board for their efforts to include Louisville, Clay City and Xenia and submit a Clay County Enterprise Zone application.

President Murbarger stated an update on survey project for 505 Route 45 property would be discussed in closed session.

Attorney Barry Bright presented resolution to approve abating the year 2015 Tax Levy for general obligation bonds (alternate revenue source), series 2011, as authorized by The Village of Louisville ordinance passed and adopted June 9, 2011. A motion made by Trustee Miller and seconded by Trustee Fender to approve the resolution. Trustee Byers absent.

Attorney Barry Bright presented 2015 Tax Levy Ordinance. After additional discussion regarding the twenty five percent tax levy increase, a motion made by Trustee Miller and seconded by Trustee Fender to approve ordinance levying taxes for the corporate purposes for the current fiscal year commencing on May 1, 2015 and ending on April 30, 2016. Trustee Byers absent. Trustee Stortzum voting no.

A motion to enter into Executive Session was made by Trustee Rinehart and seconded by Trustee Miller at 6:51 PM for the purpose of approving last month’s executive session meeting minutes, Personnel and Lease, Sale and/or Purchase of Real Estate or Possible Litigation. Trustee Byers Absent.

The Village Board of Trustees returned to open session at 7:15 PM on a motion by Trustee Rinehart and seconded by Trustee Stortzum. Trustee Byers absent.
