VILLAGE OF LOUISVILLE BOARD MINUTES

July 8, 2010 REGULAR MEETING

6:00 P.M.

The Village Board of Trustees met in regular session with Trustee Leonard, Trustee Byers, Trustee Poehler, Trustee Fender and Trustee Miller in attendance. Also in attendance were Clerk/Collector Jodi Daws, Treasurer Stephanie Bailey, Attorney Barry Bright, Bill Harrison, Superintendent Rusty Harper, Village Engineer Mike Bridges, Deputy Raymond Phillips, Beth Fancher of the Clay County Republican, Pat Garrett of WNOI and Becky Bunting of the Hometown Journal.

Trustee Rinehart entered the meeting at 6:11 p.m.

Attorney Barry Bright called the meeting to order at 6:01 p.m.

Roll Call taken and the following Village Authorities announced present at the beginning of the July 8, 2010 Regular Meeting. Trustee Jean Ann Poehler, Trustee Gene Leonard, Trustee Nancy Byers, Trustee Troy Fender and Trustee Danny Miller. President Dale Murbarger was absent for this evenings’ meeting.

Trustee Rinehart entered the meeting at 6:11 p.m.

The first motion of the evening was to appoint a temporary Chairman to conduct this evenings’ meeting. Motion made by Trustee Fender to appoint Trustee Danny Miller as temporary Chairman, and Seconded by Trustee Byers.

Motion made by Trustee Leonard to approve the June 17, 2010 Regular Meeting Minutes, seconded by Trustee Poehler.

Deputy Raymond Phillips gave the monthly police report, with 113 total complaints, 4 citations and $295.00 in fines.

A sponsorship request from The Hometown Journal was the next item on the agenda. Motion to approve a $15 sponsorship for the Louisville Fall Harvest Festival made by Trustee Fender, seconded by Trustee Byers.

Trustee Byers requested that the fence by the Water Tower be wood rather than anything else.

Trustee Rinehart entered the meeting at 6:11 p.m.

Bill Harrison then addressed the Board regarding the red tag requesting clean up on his property he recently received from the Village. Bill stated he felt this was political harassment because there are several other properties within the Village that are in equal or worse shape than his and that the owners of those properties did not receive a tag. Bill presented a photo collage identifying these properties he was referring to, but he did not leave it with the board. Bill said if he received more notices then it would be considered as political harassment and respond in kind. Bill left the meeting without requesting any action. Trustee Miller asked Treasurer Bailey how many tags were sent out at the same time as Mr. Harrison’s. Bailey indicated that there were twenty-seven sent.

Trustee Miller informed the Board that he has been informed that Slagley Construction has dropped off some of their equipment behind the Methodist Church and that they are supposed to be starting the Broadway Street Sidewalk Project as soon as possible.

The next topic up for discussion was the South Square Sidewalk Project. Trustee Miller stated there was an unforeseen problem that was discovered while working on the project. Tony Luttrell of Luttrell Backhoe informed him that there were waves going through the brickwork at the end of the concrete sidewalk and that he would not be able to continue until this was fixed. Luttrell estimated the additional cost would be approximately $2,000.00. Motion to allow Luttrell to continue and approve the additional made by Trustee Byers, seconded by Trustee Rinehart.

Trustee Miller indicated that the B-Fit roof is now complete and that the final invoice from England’s Custom Coating was in with the bills to be approved this month.

One of the lampposts at the Community Courtyard was vandalized sometime over the holiday weekend. The post was bent and one of the light fixtures was torn off the base. Treasurer Bailey indicated that there has been a police report filed already. Video footage from a security camera will be reviewed to help determine who the perpetrator(s) are so they can be charged accordingly.

Superintendent Rusty Harper informed the Board that new lighting has been installed at the circle drive turn-around at the Louisville Park. Harper stated that CIPS changed the eyes on all of the other lights as well. There are five additional lights that need repair, but these belonged to the Park District. Harper has contacted Jason Griffy to let him know about this, but Griffy has not yet returned his phone call.

Treasurer Bailey stated that she is still waiting on the informational packet for the City Entrance Signs. She will try to get the information prior to next month’s regular meeting for presentation.

Treasurer Bailey then asked the Board for permission to allow the Boy Scout and Girl Scout Troops to use the West Side of the Community Center for their monthly meetings at no charge. Motion to allow this made by Trustee Fender and seconded by Trustee Leonard.

Next on the agenda was approval of the Village’s Appropriation Ordinance for the 2011 Fiscal Year. Attorney Bright explained that the numbers are the same as what was on the Tentative Budget that was approved at last month’s meeting. Motion to approve the Appropriation Ordinance made by Trustee Fender, seconded by Trustee Miller.

Attorney Bright then began discussion of the proposed Threatening Dog Ordinance. Bright explained that in order for a dog to be deemed threatening, it first must be outside and running loose, tethered outside on a rope, cable, etc., on a leash with a person where the leash is not adequate or on a leash with a person who cannot physically maintain control of the dog. A complaint must be lodged followed by an investigation. Then a finding before the declaration is made. Once the declaration is made, a notice to abate will be issued giving the owners a chance to appeal. The final step is a series of fines that can be assessed. Bright suggested the proposed Ordinance be published in the newspaper to give the public a chance to review and comment prior to the Village’s approval. Motion to approve the Proposed Threatening Dog Ordinance and to allow the Village to publish in the media made by Trustee Leonard, seconded by Trustee Fender.

Trustee Byers then wanted to discuss the status of the red tag notices that were recently sent at the same time as Bill Harrison’s. Treasurer Bailey and Clerk Daws indicated that most have been taken care of with the exception of a few that called in and wanted to know exactly what the Board wished for them to do. This will be followed up on at next month’s regularly scheduled meeting.

Trustee Byers indicated that a sign has been placed at the stop sign located beside the Historical Society. This is against code; therefore, it should be removed immediately.

A motion to adjourn at 7:52 p.m. made by Trustee Poehler, seconded by Trustee Fender.
