OLD BUSINESS

 

The Village Board of Trustee’s met in Regular Session, those in attendance were, President Murbarger, Trustee Fender, Trustee Poehler, Trustee Miller, Trustee Byers, Trustee Rinehart. Also in attendance were Attorney Barry Bright, Superintendent Troy Elwood, Clerk Angela Stanfield, Treasurer Stephanie Bailey, Engineer Mike Bridges, Sheriff Andy Myers of Clay County Sheriff’s Office, Beth Fancher of Clay County Republican, Pat Garrett of WNOI, Steve and Emily Stortzum, Angie Frye. Gene and Rosie Leonard arrived at 6:20.

President Murbarger called the meeting to order at 6:00 PM.

Roll Call taken and the following Village authorities announced present at the beginning of the May 14, 2015 regular meeting: Trustee Danny Miller, Trustee Troy Fender, Trustee Gina Rinehart, Trustee Nancy Byers and Trustee JeanAnn Poehler.

Pledge of Allegiance followed.

A motion made by Trustee Miller and seconded by Trustee Fender to approve the agenda for May 14, 2015 regular meeting with the addition of approval of bills.

A motion made by Trustee Byers and seconded by Trustee Fender to approve April 09, 2015 Regular Meeting Minutes.

Village board concluded any old business with the old board.

Attorney Barry Bright presented a resolution which rescinds Resolution No. 780 which authorized a certain Highway Authority Agreement to be offered to Steve Stortzum doing business as Louisville Service Station. A motion made by Trustee Poehler and seconded by Trustee Rinehart to approve the resolution.

Attorney Barry Bright presented resolution which relieves the owner of any property located within a 270 ft radius of the intersection of Route 45 and Chestnut Street, which also abuts any portion of any municipally owned street, road or alleyway under which petroleum contaminants have been found, from an liability to the Village for the costs incurred by the village for cleaning and /or removing such contaminants under such streets, roads, or alleyways. A motion made by Trustee Byers and seconded by Trustee Miller to approve the ordinance.

Attorney Barry Bright presented resolution authorizing village president inform the Illinois Environmental Protection Agency that the Village finds that allowing any third party to remove any significant area of petroleum contaminant found under any municipally owned street, road or alleyway would be impractical pursuant 35 Ill. Adm. Code 742.920. A motion made by Trustee Poehler and seconded by Trustee Rinehart to approve the resolution.

A motion to enter into Executive Session was made by Trustee Miller and seconded by Trustee Fender at 6:14 PM for the purpose of approving last month’s executive session meeting minutes, Personnel and Lease, Sale and/or Purchase of Real Estate or Possible Litigation.

The Village Board of Trustees returned to open session at 6:20 PM on a motion by Trustee Byers and seconded by Trustee Miller.

A motion to approve Executive Session Minutes for April 09, 2015 Regular Meeting made by Trustee Fender and seconded by Trustee Miller.

Village board concluded all old business with the old board. President Murbarger announced at May 11, 2015 Special Meeting, Trustee Gene Leonard resigned as village trustee. President Murbarger proposed to the board that Trustee Fender and Trustee Rinehart had tied in the election, and that it was fitting to appoint Trustee Fender to fill Trustee Gene Leonard’s remaining term. Village board agreed to appoint Trustee Fender for the remaining term of resigned Trustee Gene Leonard.

President Murbarger presented a plaque to Trustee JeanAnn Poehler and thanked her for 6 years of service to village.

A motion to adjourn made by Trustee Byers and seconded by Trustee Miller at 6:26 PM.
