Meeting Minutes

The Village Board of Trustees met in Regular Session, those in attendance were President Dale Murbarger, Trustee Byers, Trustee Fender, Trustee Miller, Trustee Leonard and Trustee Rinehart. Also in attendance were Attorney Barry Bright, Clerk/Collector Angela Stanfield, Superintendent Troy Elwood, Engineer Mike Bridges, Treasurer Stephanie Bailey, Sheriff Andy Myers, Beth Fancher of Clay County Republican and Mary Maxwell of Advocate Press, Pat Garrett of WNOI. Trustee Poehler was absent.

President Murbarger called the meeting to order at 6:00 PM.

Roll Call taken and the following Village authorities announced present at the beginning of the October 9, 2014 regular meeting: Trustee Danny Miller, Trustee Troy Fender, Trustee Gene Leonard, Trustee Gina Rinehart and Trustee Nancy Byers.

Pledge of Allegiance followed.

A motion to approve the Agenda for October 9, 2014 by Trustee Rinehart and seconded by Trustee Leonard. Trustee Poehler absent.

Sheriff Andy Myers presented the Clay County Sheriff’s Office Activity Report for September 2014.

A motion made by Trustee Fender and seconded by Trustee Byers to approve Stephanie Bailey and Angie Stanfield to spend $50 each to create a Themed Basket for donation to Chamber of Commerce for the Fall Festival Themed Basket Raffle. Trustee Poehler absent.

A Motion made by Trustee Rinehart and seconded by Trustee Fender to approve advertising with WNOI Radio for Fall Festival for $75. Trustee Poehler absent.

Engineer Bridges updated the board on Waterline Replacement Project, he stated Haier Plumbing & Heating, Inc. completed construction of 4”, 6”, and 8” PVC waterlines with valves, hydrants, and miscellaneous items. Bridges stated contractor redone some of the unsatisfactory work regarding cleanup, that was discussed at last month’s meeting. Bridges informed the board the final inspection and punch list meeting will be next month. President Murbarger requested village board be notified of the meeting and participate in the final inspection punch list. Bridges also stated Rural Development has approved a change order to construct an interconnection with Clay County Water and possible funds for additional projects. Engineer Bridges and Superintendent Elwood were instructed to present possible projects for consideration for extra grant funds and present at next month’s meeting.

A motion made by Trustee Rinehart and seconded by Trustee Leonard to approve Waterline Replacement Project Change Order No. 8 for Haier Plumbing and Heating Inc., for the amount of $25,449.00, which includes the additional cost for work located on the village’s right of way by the Louisville Service Station. The change order will be submitted to Rural Development for approval. Trustee Poehler absent.

Superintendent Troy Elwood informed the board that village employees completed additional waterline work for the Clay County Sheriff’s Office expansion project for $1700. Elwood stated the extra work was due to a waterline removal request from the Sheriff’s Office. Elwood also state the waterline was scheduled to be removed at a later time. Elwood asked for direction for billing for the additional work. A motion made by Trustee Fender and seconded by Trustee Miller to waive billing that waterline construction cost to Clay County Sheriff’s Office . Trustee Poehler absent.

President Murbarger discussed replacement cost for Village Christmas Decorations. President Murbarger would like to seek funding support for the purchase of new Village Christmas Decorations.

President Murbarger agreed to supply his car and village board agreed to supply candy for the Louisville Fall Harvest Festival parade, in representing the Village of Louisville.

 

President Murbarger presented a proposal for dealing with nuisance properties in the village. President Murbarger appointed nuisance committee, which consist of Trustee Poehler, Trustee Miller and Trustee Byers, to identify, prioritize and take photos of five nuisance properties in the village which needs to be addressed first. Then notify the property owner, and allow thirty days to complete cleanup. Reevaluate property after thirty days and take additional photos, and begin legal process if no action is taken. $5000 will be authorized in legal fees if necessary to clean up those five properties. A motion for that appointed committee to identify the five properties and present the same at next month’s meeting and to authorize the $5000 in possible legal fees for that cleanup was made by Trustee Miller and seconded by Trustee Fender. Trustee Poehler absent. Trustee Rinehart voting No.

Village board opened sealed bids for purchase of property at 545 Erwin Street. Bids were received from Steve Stortzum for $852.00 and from Jack and Stacey Fulk for $6000.00. A motion was made by Trustee Rinehart and seconded by Trustee Miller to accept $6000.00 bid from Jack and Stacey Fulk and to approve the ordinance which awarded the bid to the Fulks for the $6000 bid. Trustee Poehler absent.

A motion made by Trustee Miller and seconded by Trustee Fender to authorize Attorney Barry Bright to prepare Tax Levy Ordinance with 4.9% increase for approval at next month’s meeting. Trustee Poehler absent.

A motion made by Trustee Fender and seconded by Trustee Byers to authorize Attorney Barry Bright to prepare ordinance for CCARS contract for renewal for $175 a month from October 2014 through September 2015 for approval at next month’s meeting. Trustee Poehler absent.

A motion to enter into Executive Session was made by Trustee Byers and seconded by Trustee Miller at 7:24 PM for the purpose of approving last months executive session meeting minutes, Personnel, and Lease, Sale and/or Purchase of Real Estate or Possible Litigation. Trustee Poehler absent.

The Village Board of Trustees returned to open session at 8:28 PM on a motion by Trustee Miller and seconded by Trustee Rinehart. Trustee Poehler absent.
