VILLAGE OF LOUISVILLE BOARD MINUTES

September 16, 2009 RECESSED MEETING

FROM September 10, 2009

6:00 P.M.

The Village Board of Trustees met in regular session with President Murbarger, Trustee Fender, Trustee Byers, Trustee Rinehart, Trustee Poehler, Trustee Miller and Trustee Leonard in attendance. Also in attendance were Clerk/Collector Jodi Daws, Treasurer Stephanie Bailey, Attorney Barry Bright, and Superintendent Rusty Harper.

President Murbarger called the meeting to order at 6:02 p.m.

Roll Call taken and the following village authorities announced present at the beginning of the September 16, 2009 recessed meeting: President Dale Murbarger, Trustee Gene Leonard, Trustee Nancy Byers, Trustee Gina Rinehart, Trustee Troy Fender, Trustee Jean Ann Poehler, and Trustee Miller.

The first motion was to go immediately in to Executive Session at 6:04 p.m. for the purposes of discussing personnel issues and litigation. Motion made by Trustee Byers and Seconded by Trustee Poehler.

A motion made at 7:10 p.m. to return to Open Session by Trustee Miller, seconded by Trustee Leonard.

Motion made by Trustee Fender to allow Attorney Bright to send a letter to David Rands stating what the Village wants in regards to the Nicole Worthey case. Motion seconded by Trustee Miller.

5 Ayes – 1 Nay – Motion Carried

Then a motion was made by Trustee Poehler to allow Attorney Bright to outline the Village’s desires in the Nicole Worthey case. 1. She must plead to a felony. 2. She must elocute in open court that she stole $55, 801.00 from the Village of Louisville. 3. The Village wants the $55,801.00 up front. 4. Otherwise, she should receive the usual and customary probation terms.

Motion seconded by Trustee Miller.

Trustee Rinehart then wanted to discuss the North Clay Park District water issue. She stated that the park board felt like they were smacked in the face with all of this and did not appreciate it at all. They think that they should have been told about the issue personally, rather than via the media. President Murbarger stated that he will write a letter or speak with Tammy Byers, President of the park board, to invite her and whomever else would like to come to the next regularly scheduled board meeting.

Superintendent Harper wanted to let the board know that he heard from the insurance adjuster on the tractor. The tractor only has around 2,000 hours on it, but insurance will only pay $13,900.00 for this and that the cost of a new tractor similar to this model would cost approximately $37,300.00, so we would be out about $12,000.00. Treasurer Bailey stated that she spoke with Jim Clausen and he has a letter sent to the adjuster requesting that he come back.

A motion to adjourn at 8:45 p.m. was made by Trustee Fender, seconded by Trustee Byers.
